A Notice was sent to you to tell you about the Settlement of the “class action” lawsuit that was filed against Josam Acquisitions d/b/a Good To Go Food, and this Settlement resolves the claims against Good To Go Food, the Defendant. The Notice is also to tell you about a “Fairness Hearing” to be held before Judge Michael T. Mullen on May 13, 2025 at 1:30 p.m. via Zoom (Meeting ID: 966 9558 1801; Passcode: 160424; Phone: 312-626-6799) to determine whether the proposed settlement described in the Class Action Settlement Agreement (the “Agreement”) fairly resolves the claims against Defendant as explained below.

You received the Notice because you have been identified as a person in the Class, defined as:

All persons who have been employed by Defendant at Good To Go Food located in Chicago, Illinois for whom Defendant has obtained biometric information for use with Defendant’s timekeeping system from December 13, 2014, to November 18, 2024.

There are two Subclasses which are defined as:

Subclass of Class Members without a Purported Release

Class Members who Defendant does not assert have signed any release of their BIPA rights against Defendant; and

Subclass of Class Members with a Purported Release

Class Members who Defendant asserts have signed any release of their BIPA rights against Defendant.

Accordingly, you are eligible to participate in the Settlement of this lawsuit by completing a Claim Form HERE or timely mailing it to the Claims Administrator. To receive your share of the Settlement Fund, you must submit a Claim and Release Form not later than April 15, 2025. The Claim and Release must be signed and returned without alteration or amendment.

If you are a Class Member and accurately complete and timely submit the Claim Form you will receive a share of the Net Settlement Amount.
